Calif. high court to hear Proposition 8 lawsuits

SAN FRANCISCO, CA, USA — California’s highest court has agreed to hear legal challenges to the state’s new same-sex marriage ban, but is refusing to allow gay couples to resume marrying until it rules on the measure’s validity.

The California Supreme Court accepted three lawsuits seeking to nullify Proposition 8, a voter-approved constitutional amendment that overruled the court’s May decision legalizing gay marriage. As is its custom when it takes up cases, the court did not elaborate on its decision.

Along with the gay rights groups and local governments petitioning to overturn the ban, the measure’s sponsors and Attorney General Jerry Brown had urged the Supreme Court to consider whether Proposition 8 passes legal muster.

The court directed Brown and lawyers for the Yes on 8 campaign to submit their arguments for why the ballot initiative should not be nullified by Dec. 19 and lawyers for the plaintiffs, who include same-sex couples who did not wed before the election, to respond before Jan. 5. Oral

Both opponents and supporters of Proposition 8 expressed confidence Wednesday their arguments would prevail. But they also agreed the cases present the court’s seven justices — six of whom voted to review the challenges — with complex questions that have few precedents in state case law.

All three cases claim Proposition 8 abridges the civil rights of a vulnerable minority group. The lawsuits argue that voters alone did not have the authority to enact such a significant constitutional change.

Local church leaders came together, with a message for opponents of Proposition 8, the voter approved measure that bans same sex marriage. It comes after threats against churches in Fresno, Los Angeles, and Utah.
Local religious leaders say enough is enough. They called for opponents of Proposition 8 to step back and let the courts rule on the validity of same sex marriages.
A catholic priest, a reverend and a stake leader from the church of latter day saints all stood together, united in the belief churches and members should not be targeted in the fallout over Proposition 8.
Jim Franklin said, “They talk about basic civil rights. Our very foundational one is freedom of religion and freedom of speech. But yet they would try to intimidate that. It just seems pretty hypocritical that they would say they want our rights but we want to intimidate other people from operating in theres.”

Daylight Saving Time: Why Did We Do It?

At 2:00 a.m. local on Sunday, most of the United States (except Hawaii and Arizona) will leave daylight saving time behind and fall back an hour to standard time.

The annoyance of resetting clocks (or forgetting to, and showing up an hour early for appointments on Sunday) may raise the question of why we bother with this rigmarole in the first place.
